Welcome to Bounceville! These Terms and Conditions ("Terms") govern your use of our website, online booking system, and physical facility located at 1986 N Wickham Rd, Melbourne, FL 32935. They form a legal agreement between you and Bounceville Melbourne LLC ("Bounceville," "we," "us," or "our").
By visiting our facility, booking a party, purchasing open play passes or memberships, using our website, or otherwise engaging our services, you agree to these Terms. If you do not agree, please do not use our services.
1. Eligibility and Acceptance
You must be at least 18 years of age to book a party, sign a waiver, purchase a membership, or enter into any agreement with Bounceville. By using our services, you confirm that you are 18 or older and have the legal authority to enter into these Terms on behalf of yourself and any minor children in your care.
2. Waivers and Participation
All guests stepping onto the bounce floor, soft play area, or any active play surface must have a signed liability waiver on file before participating. This includes children, parents, siblings, grandparents, and any other adults choosing to play.

Waivers must be signed by a parent or legal guardian for any participant under 18

Waivers are required regardless of how short the visit is

Photo identification may be requested at our discretion to verify identity or age

Waivers may be valid for a defined period (typically one year) — check your most recent waiver for details

Submitting false information on a waiver is grounds for immediate removal from the facility without refund
3. Safety, Conduct, and Right of Refusal
Bounceville reserves the right to refuse service, deny entry, or remove any guest at any time, with or without refund, for reasons including but not limited to:

Failure to follow posted safety rules or staff instructions

Disruptive, unsafe, or aggressive behavior

Visible illness, fever, or contagious symptoms
-
Intoxication or impairment
-
Violation of these Terms

Harassment of staff or other guests

Damage to property or equipment
Guests must follow all posted rules, attendant instructions, age and height restrictions on individual attractions, and grip sock requirements. Parents and guardians are responsible for supervising their children at all times. Bounceville staff are not responsible for supervising your children.
4. Health, Safety, and Assumption of Risk
Bounce houses, inflatable attractions, soft play structures, and active play surfaces involve inherent risks of injury, including but not limited to bruises, sprains, fractures, concussions, and other physical injuries. By participating, you and any minors in your care voluntarily assume these risks.
You agree not to participate (and not to allow your child to participate) if you or they have:

Any medical condition that may be aggravated by physical activity

Recent injuries, surgery, or pregnancy
-
A communicable illness
-
Heart, neck, back, or bone conditions
If you are unsure whether participation is safe, consult a physician before visiting. Bounceville does not provide medical advice.
5. Bookings, Deposits, and Payments
Birthday Party Bookings

All party bookings require a non-refundable 50% deposit at the time of booking

The remaining balance is due on or before the day of the party

We accept payment via credit card, debit card, and other methods specified at checkout
-
A surcharge may apply to credit card transactions; debit card transactions may also include a small processing fee. Surcharges and fees are disclosed at the time of payment

Add-ons (extra pizza, additional children, ice cream, etc.) are billed separately and must be paid in full before or at the time they are added to your booking
-
Gratuity for your party host is not included and is appreciated at your discretion (suggested minimum tips are listed in your booking confirmation)
Open Play, Passes, and Memberships

Open play admission and passes must be paid in full at the time of purchase
-
Memberships are paid monthly and are not transferable
-
Membership benefits, restrictions, and access days (e.g., Monday-Thursday only) are disclosed at the time of purchase

Memberships are not subscription-based auto-renewals unless explicitly stated; you must renew each month
-
Lost or stolen membership cards or accounts are the customer's responsibility to report
6. Cancellation, Refunds, and Date Changes
Birthday Parties

The 50% deposit is non-refundable under all circumstances, including but not limited to illness, weather, scheduling conflicts, or change of plans
-
Cancellations forfeit the 50% deposit in full
-
Date changes may be accommodated when requested at least 14 days before the scheduled party, subject to availability. Date changes within 14 days are not guaranteed and may be denied at our discretion

Date changes may be limited to one rescheduling per booking
-
No-shows are treated as cancellations. The deposit is forfeited and the remaining balance may still be charged

If Bounceville must cancel a party due to facility issues, equipment failure, or events within our control, we will offer a full refund or rescheduling at the customer's choice
-
Force majeure events (natural disasters, power outages, government orders, etc.) are governed by Section 14
Open Play Admissions

Open play admissions are non-refundable once activated or used
-
Unused single-day admissions may be honored on a future date at our discretion

Membership payments are non-refundable. Memberships may be canceled at any time but no refunds will be issued for the current paid month
Add-Ons and Merchandise

Custom add-ons (food, ice cream, additional children added to a party) are non-refundable once provided or prepared
-
Merchandise (grip socks, shirts, etc.) may be returned unused with receipt within 14 days of purchase, subject to inspection
7. Chargebacks and Disputes
By making a payment to Bounceville, you agree to contact us directly to resolve any billing disputes before initiating a chargeback with your card issuer. Filing a fraudulent or unjustified chargeback is a breach of these Terms.
In the event of a chargeback, Bounceville will provide all relevant documentation — including your signed waiver, booking confirmation, agreement to this cancellation policy, and any communication — to dispute it. Customers who file fraudulent chargebacks may be banned from future bookings and may be liable for collection costs and legal fees.
8. Photography and Video
Bounceville may take photos and videos at our facility for use in marketing, social media, and promotional materials. By entering our facility, you consent to being photographed in public areas. If you do not wish to appear in our marketing, please notify a staff member upon arrival.
You may also take your own photos and videos for personal use. Commercial photography or videography (including for social media monetization, professional photoshoots, or media coverage) requires prior written permission from Bounceville management.
9. Lost, Stolen, or Damaged Property
Bounceville is not responsible for personal items lost, stolen, or damaged on our premises. We recommend leaving valuables at home or in your vehicle. Found items may be held at the front desk for up to 14 days before being donated or discarded.
Guests are responsible for any damage they cause to Bounceville property, equipment, or facility. Customers may be billed for repair or replacement costs.
10. Outside Food and Beverages
Outside food and beverages are not permitted unless explicitly part of a booked party package or pre-approved by management. Cakes, cupcakes, and birthday-specific desserts are welcome for private parties. Specific food allergies should be disclosed at booking so we can accommodate where possible.
Alcohol is not permitted on our premises.
11. Use of Our Website
Our website is provided for informational purposes and to facilitate bookings. You agree not to:

Use our website for any illegal purpose

Attempt to interfere with the operation or security of our website

Copy, reproduce, or distribute our content without permission
-
Use automated tools (bots, scrapers, etc.) to access our website

Impersonate another person or provide false information when booking
We reserve the right to suspend or terminate your access to our website or services at any time for any reason.
12. Intellectual Property
All content on the Bounceville website and at our facility — including the Bounceville name, logo, designs, photographs, marketing materials, and written content — is the property of Bounceville Melbourne LLC and is protected by copyright, trademark, and other intellectual property laws. You may not use, copy, or distribute our content without our written permission, except for personal, non-commercial use.
13. Disclaimers and Limitation of Liability
To the fullest extent permitted by Florida law:

Bounceville's services are provided "as is" without warranties of any kind, express or implied

We do not warrant that our website will be uninterrupted, error-free, or secure

Bounceville's total liability to you for any claim arising out of or related to these Terms or your use of our services is limited to the amount you paid to Bounceville in the 12 months preceding the claim
-
In no event will Bounceville be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or emotional distress

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence or willful misconduct
This limitation does not waive or replace the liability releases contained in your signed waiver, which remain fully enforceable.
14. Force Majeure
Bounceville is not liable for failure to perform under these Terms due to events beyond our reasonable control, including natural disasters, hurricanes, severe weather, fire, flood, pandemics, government orders, power outages, internet or system outages, labor disputes, or supply chain failures. In such cases, we will work in good faith to reschedule affected bookings or provide credit toward a future visit. Refunds for force majeure events are at Bounceville's discretion.
15. Indemnification
You agree to defend, indemnify, and hold harmless Bounceville Melbourne LLC, its owners, employees, contractors, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of:

Your use of our facility or services

Your violation of these Terms

Your violation of any third party's rights

Any false or misleading information you provided to Bounceville

The conduct of any minor child in your care during a Bounceville visit
16. Governing Law and Venue
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of Bounceville's services will be resolved exclusively in the state or federal courts located in Brevard County, Florida. You consent to the personal jurisdiction of these courts.
17. Dispute Resolution
Before filing any lawsuit, you agree to first attempt to resolve any dispute informally by contacting us at Bounce@BouncevilleMelbourne.com with a clear description of the issue and the resolution you are seeking. We will respond within 30 days. Most disputes can be resolved this way without legal action.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
19. Entire Agreement
These Terms, along with our Privacy Policy, Refund Policy, and any signed waivers, constitute the entire agreement between you and Bounceville Melbourne LLC regarding your use of our services and supersede any prior agreements or communications.
20. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Material changes will be posted prominently on our website. Your continued use of our website or services after changes are posted means you accept the updated Terms.
